Terms of Service

1. Agreement to Terms

By accessing or using https://getghosthosts.com, requesting any resource, booking a strategy call, or engaging Ghost Hosts for any service, you agree to be bound by these Terms. If you do not agree, do not use our website or services.

2. Services

Ghost Hosts provides advisory, operational, and fractional leadership services to STR/MTR operators, including:

• STR Rescue Audit
• Ops + Revenue System Build (Ghost OS)
• Fractional COO Partnership
• Fractional CRO Partnership
• Digital resources including the STR Rescue Checklist

Specific scope, deliverables, and fees are set out in a separate Statement of Work (SOW). In the event of a conflict between these Terms and the SOW, the SOW controls.

3. Website Use

You may use our website for lawful purposes only. You agree not to:

• Violate any applicable laws or regulations
• Send unsolicited advertising or spam
• Attempt unauthorized access to any part of our systems
• Scrape or harvest content without permission
• Impersonate any person or entity

4. Free Resources

By requesting free resources (such as the STR Rescue Checklist), you consent to receive email communications from Ghost Hosts. Free resources are provided for informational purposes only and do not constitute professional advice. You may unsubscribe at any time.

5. Strategy Calls

Strategy calls are complimentary consultations only. No client relationship is created by booking or attending a strategy call. Please provide at least 24 hours notice to cancel or reschedule.

6. Paid Services

a) Fees and Payment

Fees are specified in the applicable SOW. Late payments may incur interest at 1.5% per month (or the maximum permitted by law, whichever is less).

b) Cancellation and Refunds

Fees paid for completed work are non-refundable. Any cancellation terms specific to your engagement will be set out in your SOW.

c) Client Responsibilities

Clients agree to:

• Provide timely access to tools, data, and team members as requested
• Respond promptly to requests for information and decisions
• Implement agreed changes in a timely manner

Ghost Hosts is not responsible for delays or reduced outcomes resulting from client failures to meet these responsibilities.

d) No Employment Relationship

All services are provided as an independent contractor. Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship.

7. Intellectual Property

a) Ghost Hosts IP

All frameworks, methodologies, templates, and tools — including Ghost OS and the STR Rescue Checklist — are the exclusive intellectual property of Get Ghost Hosts LLC. Clients receive a limited, non-transferable license for internal use during the engagement only.

b) Client Materials

You retain ownership of your business data, content, and materials. You grant Ghost Hosts a limited license to use these materials solely for the purpose of delivering the agreed services.

c) Website Content

All content on getghosthosts.com — including text, graphics, logos, and videos — is owned by Get Ghost Hosts LLC and may not be reproduced without express written permission.

8. Confidentiality

Both parties agree to keep confidential any non-public, proprietary information shared during an engagement. This obligation survives termination of the engagement for a period of two (2) years.

9. Disclaimers

Services are provided "as is." Ghost Hosts makes no guarantees regarding specific outcomes, revenue growth, or operational results. Results depend on many factors outside our control, including client implementation and market conditions.

10. Limitation of Liability

To the maximum extent permitted by law, Get Ghost Hosts LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim arising from these Terms or our services is capped at the total fees paid by you in the three (3) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Get Ghost Hosts LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

12. Dispute Resolution

a) Informal Resolution

Before pursuing formal dispute resolution, both parties agree to attempt to resolve any dispute through good-faith negotiation for at least 30 days. Contact us at hello@getghosthosts.com.

b) Binding Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration under the AAA Commercial Arbitration Rules, with arbitration conducted in Sheridan, Wyoming.

c) Class Action Waiver

You waive any right to bring claims against Ghost Hosts as a class action, consolidated action, or representative action.

d) Exceptions

Either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.

13. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.

15. Miscellaneous

• Entire Agreement: These Terms, together with any applicable SOW, constitute the entire agreement between the parties.
• Severability: If any provision is found unenforceable, the remaining provisions continue in full effect.
• Waiver: Failure to enforce any right or provision does not constitute a waiver of that right.
• Assignment: You may not assign these Terms or any rights hereunder without Ghost Hosts' prior written consent.
